Item: product of any kind offered for sale on the Site
Customer: an individual with full legal capacity placing an order
Order: a commitment to purchase the items selected by the Customer via the e-commerce section of the Site
Site: website and social media e-commerce facilities produced by Jasper Peto France SARL on behalf of Anthony Peto and Atelier 144, such website being accessible at www.anthonypeto.com
These general terms of sale (hereinafter “TOS”) apply exclusively between the Customer and Jasper Peto France SARL whose head office is located at 56 rue Tiquetonne, 75002 Paris, France, and registered at the Companies Register in Paris under the number 345303697 (hereinafter “Jasper Peto France”).
The TOS are applied without restriction or reserve to all the items for sale on the Site.
Any order on the Site is conditional upon the prior consultation and acceptance, without reserve, of these TOS and applicable tariffs by the customer.
The validation of an Order following the order procedure offered on the Site requires acceptance of these TOS.
These TOS take precedence over any other document.
The sale of Items on the Site is exclusively reserved for retail sales to private individuals.
All customers must be aware of the unreliability of the internet in terms of security in data transmission, continuity in unsecured access to the Site and lack of guarantees as to volume and speed of data transmission and virus propagation.
The TOS are subject to modification, and thus the relevant conditions concerning an Order are those in place at the time the Order was made.
The handling of defective or non-compliant Items and/or the exercise of a right to a refund or a return of an Order cannot be carried out in any physical retail outlets.
All claims relating to Items purchased on the Site must be conducted online.
An Item purchased in a physical retail outlet cannot be processed via the Site.
Placing an Order on the Site requires the prior creation of a customer account.
Any adult Customer can freely and without charge create an account via the “Create an account” section.
The creation of an account is implemented by the Customer filling out the form requesting identification information.
The account is strictly personal and enables the Customer to log in before placing an Order.
When creating a customer account, the Customer enters data that allows their identification under the Customer’s full responsibility, control and direction, and commits to providing complete, accurate and up to date information, and not to assume the identity of a third party nor to hide or provide inaccurate information regarding their age.
During the creation of a customer account, the Customer chooses their user name and password.
Should the user name be already assigned, the Customer will be prompted to choose another.
User names and passwords are personal and confidential. The Customer has sole responsibility for them.
The Customer undertakes to keep their password secret and not to disclose it under any circumstances or for any reason.
If it is suspected that that a user name or password has been used by a third party, the Customer must immediately alert Jasper Peto France to change the password or to close the customer account.
Jasper Peto France réserves the right to close any customer account and to refuse any sale to a Customer in the following cases.
• lack of payment for one or several past Orders
• abuse, unfair or fraudulent use of the Order service provided on the Site or failure to respect any of the Customer’s obligations as set out in the TOS.
In this case Jasper Peto France will e-mail the Customer concerned using the e-mail address provided by the Customer during the creation of their customer account, informing them of the deactivation of their user name and password and the closing of their account. The Customer may be informed of the closure of their account following an e-mail request by the Customer addressed to Jasper Peto France.
The Items available for sale are those featured as being for sale on the Site. The offers are valid as long as these Items are visible on the Site.
They are offered for as long as their availability is displayed on the site.
Jasper Peto France reserves the right to remove from sale any Item from the Site and to replace or modify any information on the Site associated with the Items on the Site.
In the event of the unavailability of an Item after the placing of an order, the Customer will be notified by e-mail and the Order will automatically be cancelled.
The characteristics of Items sold sold on the Site, as relayed through photographs, graphics, descriptions and other means, are purely indicative and may vary over time. They are not contractual.
Only the image of the Item as shown at the time of the Order can be taken into consideration by the Customer.
In the event of errors or omissions relating to the description of an Item, the responsibility of Jasper Peto France is limited to the reimbursement of reasonable return shipping fees for the Item concerned.
The ordering of an Item requires the Customer to register into or to log into the customer account.
The Customer declares being at least 18 years old and to having full legal capacity, or in the case of being a minor to having parental permission to place the Order.
In placing an Order, the Customer must follow the online purchase process and click on “Order” to place an Order.
The payment of the Order requires the acceptance of these TOS, the price of the Item or Items and the content of the Order.
After validation of payment, Jasper Peto France sends an order confirmation to the Customer by e-mail.
Every Order is subject to prior acceptance by Jasper Peto France and is not definitively confirmed until the Customer has received an e-mail confirming the shipping of the Item.
If the Customer does not receive an e-mail following their order, they must contact customer service by e-mail via the contact form located on the Contact page of the Site.
Jasper Peto France cannot in any circumstances be held responsible for any input error or transmission of an input error leading to the non issuance of the confirmation e-mail and/or Items.
It is recommended that the Customer print out the Order confirmation e-mail.
Regarding the tracking of the Order, the Customer may contact customer service by filling out the contact form located on the Contact us page of the Site.
Prices on the Site are indicated in euros. These include all French taxes but do not include taxes that may be collected in the destination country. Prices do not include processing, handling, packaging and shipping costs.
Prices include VAT and potential discounts applicable at the time of the Order.
Any new taxes or contributions such as environmental taxes or contributions may be added to the retail price of the Item.
Shipping and other costs are specified on the Site before validation of the Order.
Jasper Peto France reserves the right to modify the prices of any Item at any time.
The invoiced price is the price indicated as such during the Order.
The Items remain the full property of Jasper Peto France until complete payment of the price which the Customer recognises and accepts.
The price invoiced to the Customer is the price indicated in the Order confirmation sent to the Customer by e-mail.
The Order is payable immediately by bank card (CB, Visa, Mastercard, American Express).
The Customer is informed by e-mail, once the Order is shipped, that the invoice, including shipping fees as applicable VAT, is accessible online on the Customer account.
The transactions carried out on the Site are entrusted to STRIPE, the secure online payment platform.
They are secured by a solution that presents highly secured pages to enter payment information: card number, expiration date and the visual cryptogram.
The platform encrypts then transmits this payment information to the bank, in full confidentiality and makes them accessible to third parties.
The price invoiced to the Customer is the price indicated in the Order confirmation sent to the Customer by e-mail.
The Order is payable immediately by bank card (CB, Visa, Mastercard, American Express).
The Customer is informed by e-mail, once the Order is shipped, that the invoice, including shipping fees as applicable VAT, is accessible online on the Customer account.
The transactions carried out on the Site are entrusted to STRIPE, the secure online payment platform.

The platform encrypts then transmits this payment information to the bank, in full confidentiality and makes them accessible to third parties.
The Customer may see several delivery options to be chosen by the Customer and at the expense of the Customer.
The Customer will receive an e-mail with an Order number confirming the processing of the Order.
The Items ordered will be delivered within a maximum of 30 days after the registration of the Order upon condition of complete payment of the price.
The Customer may track the delivery using the tracking number of the carrier, on the website of the carrier chosen by the Customer (if applicable).
The Customer undertakes to provide the entire and the exact information necessary for the proper fulfilment of the Order and seamless delivery including access codes and other access details.
If the Customer is not at home at the time of delivery a note is left informing the Customer as to how to how the package will be made available, under the complete and exclusive responsibility of the carrier.
If the delivery address provided by the Customer is invalid and causes the package to be returned due to non-receipt at the indicated address, the return shipping fees to the new address provided will be covered by the Customer.
The Customer fully and exclusively assumes the risks related to the Items in the delivery process.
The Items are delivered to the delivery address indicated by the Customer in the Order at the date of the Order.
Jasper Peto France undertakes to do its utmost to deliver the Order within a maximum of 30 days from the placing of the Order. In most cases the Items will be shipped within 7 working days, unless otherwise indicated. In the case of bespoke hats from Atelier 144 the delays may well be longer and Customers will be advised as to the delivery date scheduled.
In the event of a delay exceeding the above, unless the Customer has agreed otherwise, the Customer may contact Jasper Peto France and request cancellation of the Order within 60 working days.
The contract and the sale will be considered breached upon receipt by Jasper Peto France of the e-mail or letter in which the Customer informs Jasper Peto France of its decision, unless the delivery takes place between the shipping and the receipt of the e-mail or letter from the Customer.
If the Customer receives the package after the cancellation of the order Jasper Peto France will refund the Items and return shipping costs provided that all the Items are received in their perfect original condition. This is subject to the provisions of the previous paragraph.
In the event of the Order being permanently cancelled, the Customer will be refunded the price paid for the Order within 30 days of the cancellation being confirmed by e-mail.
Each delivery is deemed completed upon provision of the package to the Customer by the Carrier as evidenced by the control system used by the carrier.
If the package is damaged or the Item does not match the Order the Customer must contact customer service by filling out the contact form in the Contact Us page of the Site. The return must be made within 30 days of dispatch following the returns procedure set out below.
In the event of delivery requiring an appointment with the Customer, the carrier will contact the Customer as soon as possible to arrange an appointment for delivery.
Jasper Peto France cannot be responsible for late delivery due to the unavailability of the Customer after several proposals for appointments by the carrier.
If in the course of the same Order the delivery dates of several items differ, the delivery time is based on the latest date specified on the Order or notified by Jasper Peto France.
If delivery of an Item does not match the Customer’s Order or has a transport related defect, the Customer may return the Item following the procedures set out below.
The refund procedure is exclusive of any exchange.
To return an Item and receive a refund:
Customers must notify Jasper Peto France of their claim by e-mail within a maximum of 30 calendar days following dispatch of the Item
Any claim filed after this deadline will not be accepted and Jasper Peto France will be released from any liability.
Customers must return their non-compliant Item within a maximum of 14 calendar days in the form of a well packaged parcel.
Returns must be addressed to: Anthony Peto, 56 rue Tiquetonne, 75002 Paris, France, tel +33140266068, either by post or by carrier. Returns cannot be accepted in any
other way.Any non-compliant return will be rejected and Jasper Peto France will be released from liability.
On accordance with national and European consumer protection laws, any Customer within the European Union has a period of 14 days from receipt of the Order to exercise their right to cancel and return an Order without having to give any reasons or incur any penalty.
All returns must include all the Items with which the Customer was not satisfied.
These Items must be returned fully protected in their original packaging and in resalable condition, undamaged, unused and unsoiled, using the return address form sent with the Order.
Once the return is validated, Jasper Peto France will refund the Customer the full amount paid for the Order, excluding shipping costs, to the Customer’s bank account as used for payment of the Items, no later than 30 days after the right has been exercised.
In the case of the right to retraction, the risks related to the return are the responsibility of the Customer.
For any information or questions relating to returns and to exercise the right to return the Customer must contact our customer services by e-mail using the contact form located on the Contact us page.
Items are guaranteed against compliance defects in accordance with Articles 1641 to 1649 of the Civil Code and L211-1 et seq. of the Consumer Code, as of delivery:
Article 1641 of the Civil Code: the seller is obliged to provide a warranty against hidden defects of the article sold which render it unfit for the use for which it was intended, or that decreases this use so that the buyer would not have purchased it or would have paid a lower price if he/she had known.
Article 1648, paragraph 1 of the Civil Code: the action resulting from latent defects must be filed by the purchaser within 2 years after discovery of the defect.
Article L. 211-4 of the Consumer Code: the seller must deliver goods in compliance with the contract and is liable for compliance defects existing at the time of delivery. It also addresses lack of compliance resulting from the packaging, instructions for assembly or installation when it was assigned by the contract or carried out under its responsibility.
Article L. 211-5 of the Consumer Code: to comply with the contract the Item must:
1. Be suitable for the purpose usually expected of a similar item, and where appropriate:
2. correspond to the description given by the seller and possess the qualities that it has presented to the buyer as a sample or model.
• feature the qualities that a buyer might reasonably expect given the public statements made by the seller, the manufacturer or its representative, particularly in advertising or labelling.
1. Or have the characteristics defined by mutual agreement by the parties or be suitable for any particular purpose which the buyer made known to the seller and the latter accepted.
• Article L211-12 of the Consumer Code: the action resulting from lack of compliance is recorded within 2 years after delivery of the goods.
This guarantee allows the Customer to return the defective or non-compliant Item delivered for a refund under the aforementioned conditions.
The Customer recognises and accepts that the Order recording systems document all the transactions made between Jasper Peto France and the the Customer.
The Customer recognises and accepts that the proof of acceptance of the TOS is characterised by checking the box “I have read and accept the general terms of sale.”
For this purpose the Customer acknowledges and agrees that the electronic data stored in Jasper Peto France’s computer systems in reasonable conditions of security and integrity are considered irrefutably as evidence of acceptance of the terms of the TOS and the proof of all transactions between the Customer and the Jasper Peto France.
Jasper Peto France will save the purchase orders and invoices on a reliable and durable medium, pursuant to the provisions of Article 1348 of the Civil Code and guaranteeing access to the Customer at any time if they so request it in accordance with r eh provisions of Article L. 134-2 of the Consumer Code.
Consequently, unless a clear error on the part of Jasper Peto France is proved by the Customer, the latter cannot challenge the admissibility, validity or probative value of the TOS and the content of the Order, based on any of the legal provisions that exist and that specify that certain documents must be written or signed to constitute proof.
Thus, these elements constitute proof, and if they are produced as evidence by Jasper Peto France in any litigation or otherwise, shall be admissible, valid and opposable in the same manner, under the same conditions and with the same probative value as any document created, received or retained in writing.
At any time, the Customer can print, download and save a copy of the TOS to a paper or electronic medium.
Jasper Peto France reserves the right to modify the information on this Site at any time and without notice.
Jasper Peto France undertakes to describe with great accuracy the Items sold on the Site and to ensure under the best conditions the updating of the information that is disseminated.
However, Jasper Peto France cannot guarantee the accuracy, precision or comprehensiveness of the information made available to the Customer on the Site.
In the case of there being no substantial differences between the presentation of photographs of Items as well as texts and illustrations of Items on the Site, and the Items ordered, there will be no responsibility or liability on the part of Jasper Peto France.
The Customer acknowledges and agrees that the prices of Items may vary between physical stores and the Site, and in no circumstances may such a price difference serve as a basis for a claim for a total or partial refund of Items purchased on the Site or in physical stores.
The responsibility of Jasper Peto France cannot be upheld in the event of that one of its contractual obligations is not fulfilled as a result of unforeseen circumstances or force majeure as defined by case law rendered by the French courts.
Jasper Peto France shall not be held responsible for any non-performance or delay in the execution of Orders caused by events beyond its control (the case of Force Majeure).
In particular, Jasper Peto France shall not be held responsible for any non-performance, omission or accident beyond the control of Jasper Peto France including but not limited to the following.
1. Strikes, closures or other industrial or social actions
2. Civil upheaval, riots, invasions, terrorist attacks, threats of terrorist attacks, wars whether declared or otherwise, or threats or preparations for war
3. Fires, explosions, storms, floods, earthquakes, subsidences, epidemics, pandemics or other natural disasters
4. The inability to use transportation by train, boat, plane, roads or other means of private or public transportation
5. The inability to use public or private telecommunications networks
6. Acts, decrees, legislation, regulations or restrictions of all or any governments
7. Strikes, failure or accidents of maritime, postal, air or any other transportation
The application and execution of the TOS shall be suspended for as long as the case of Force Majeure continues and the execution and delivery lead times shall be extended accordingly. Jasper Peto France will endeavour as far as possible to end the Force Majeure or to find a solution allowing it to fulfil its contractual obligations despite the Force Majeure.
Jasper Peto France is solely responsible for any damage that is directly foreseeable at the time of use of the Site or the conclusion of the sales contract with the Customer, to the exclusion of all indirect damages.
Jasper Peto France grants a license that is limited to the access and use of the Site for personal and non-professional or commercial use of the Site to the Customer.
In no circumstances is the Customer authorised to download or modify all or part of this Site without the written and express permission of Jasper Peto France.
This Site or any part of this Site cannot in any way be reproduced, copied, sold or exploited for commercial or professional reasons without the written and express permission of Jasper Peto France.
The Customer cannot use techniques allowing a trademark, logo or any other information (notably images, texts, models), of which Jasper Peto France is the owner, to be copied without its express and written consent.
Jasper Peto France authorises the Customer, non-exclusively and on a revocable basis, to create a hyperlink to the homepage of the Site provided that this link cannot create derogatory, untrue, false, infringing or other forms of possible harm against Jasper Peto France products, any of the trademarks with which it is associated, or to Jasper Peto France itself.
Under nocircumstances can the creation of a hyperlink incur the liability of Jasper Peto France in any capacity whatsoever.

Jasper Peto France may send commercial offers by post, e-mail, sms, telephone, WhatsApp or via any web spaces run by Jasper Peto France or any of its subsidiaries on social networks, subject to prior acceptance.
At any time the Customer or visitor to the Site has the ability to cancel these commercial notifications, without cost, by clicking on the unsubscribe link appearing in each email.
When visiting the Site, information pertaining to the visitor’s browsing may be recorded in “cookies” installed on their terminal (computer, tablet, telephone etc).
These cookies are issued by Jasper Peto France in order to facilitate browsing on the Site and allow recognition of visitors’ browsing by Jasper Peto France when they are connected to the Site.
These cookies are issued in order to:
• Establish visitor statistics (number of visits, pages viewed, cancellation of the order process, etc)
• Adapt the presentation of the Site to the display settings of terminals
• Memorise the information entered in forms, manage and secure access to reserved and personal spaces such as the Customer account, and manage the Order basket
Jasper Peto France reserves the right to implant cookies on the visitor’s computer when they are visiting the Site.
A cookie is a small file that is sent to the visitor’s terminal and stored on the hard drive. If the visitor is registered with Jasper Peto France their terminal will store an identification cookie that will save time whenever they visit the Site, since it will remember the visitor’s email address.
A cookie does not allow the identification of the visitor but its purpose is to note the visitor’s prior visits in order to help Jasper Peto France to personalise its services.
The visitor may configure settings so that cookies are deactivated and avoid the installation of cookies to their terminal without their express consent.
Any settings implemented by the visitor will be liable to affect internet browsing and conditions of access to certain services on the Site requiring the use of cookies.
The visitor may express and modify at any time their wishes pertaining to cookies by the methods below.

Jasper Peto France is under no circumstances responsible for the content or operation of any of the social networks including those that that may be connected to the Site.
Jasper Peto France has an exclusive licence to intellectual property rights
• over the Items sold on the Site
• over the trademarks associated with the Items
• over the Site and in particular its layout, organisation and titling of categories, its visual and graphic identity, its design, its ergonomics, its features, its software, text, animated or fixed images, sounds, know-how, drawings, graphics and all other elements making up the Site.
• over the databases, their structure and their content, designed and managed by or on behalf of Jasper Peto France including for the editing needs of the Site
• over all the design elements of the Site, both graphic and technical
• over all the names, acronyms, logos, colours, graphics and other signs that may be used, completed or implemented by Jasper Peto France.
It is therefore expressly forbidden to reproduce in any form whatsoever, directly or indirectly, the items listed on the preceding paragraph and the preceding bullet points, as well as to alter the trademarks, patents, names, acronyms, logos, colours, graphics or other signs appearing on the elements provided within the Site, and more generally to use or exploit these elements other than in connection with the execution hereof.
As such, the reproduction or use of all or part of these elements is only authorised for the purposes of information for personal and private use. Any reproduction and any use of copies made for other purposes is expressly prohibited.
Any other use without the prior and written permission of Jasper Peto France constitutes infringement and shall be punished according to intellectual property regulations.
Any hyperlink to the homepage of the Site or to any other page of the Site is subject to the prior and written agreement of Jasper Peto France.
In view of possible changes to the Site and to regulations, Jasper Peto France reserves the right to alter the TOS at any time.
The new TOS will be, as appropriate, made known to the Customer and/or the visitor by online modification and will be applicable only to sales completed after such modification.
These TOS are subject to French law.
Any dispute will fall under the exclusive competence of the French courts within the jurisdiction of the Customer’s or visitor’s domicile if no amicable agreement is reached beforehand.
